What is OSHA compliance? Building a safer workplace

On construction sites, every day brings new hazards. A crew starts cutting concrete, and silica dust fills the air. A guardrail comes off a scaffold to move material and doesn’t go back up. A new sub shows up without the right personal protective equipment (PPE) for the site. 

Situations like these are the reason construction has one of the highest fatality counts of any private sector. To protect worker health and safety, the Occupational Safety and Health Administration (OSHA) regulates jobsites. They set and enforce workplace standards for everything from fall protection to cave-in prevention.

This guide explains OSHA compliance, its impact on construction safety, and how to build a safer workplace.

What is OSHA compliance?

OSHA compliance means following Occupational Safety and Health Administration regulations. Some standards cover general workplace safety, but because construction has so many high-risk environments, the industry has its own set of regulations defined in 29 CFR 1926.

The most cited is OSHA’s fall protection standard. Falls are the leading cause of construction fatalities, and they’re preventable. That’s why OSHA has extensive guidance on fall protection, guardrails, and harnesses.

OSHA’s construction standards also include (but aren’t limited to) requirements around: 

  • Hazardous chemical control
  • PPE
  • Fire prevention
  • Scaffolding
  • Excavation and trenching
  • Electrical
  • Crane operation
  • Sloping

Violating these regulations could lead to consequences like stop-work orders, legal proceedings for willful violations resulting in death, and significantly higher penalties for repeat offenders.

Key elements of OSHA compliance

Here’s a closer look at four areas of OSHA compliance that construction leaders should take note of.

Employer responsibilities

Employers and workplace leaders must follow the General Duty Clause, which states that workplaces comply with OSHA regulations and are free from hazards likely to cause serious harm. OSHA takes violations seriously: If someone knows about a hazard but does nothing to resolve it, the agency could issue a fine of up to $165,514 per violation and even halt work.

Training and education 

Every worker who will face hazards on the job must go through OSHA training. The agency breaks up training requirements by industry, and construction has its own dedicated section. OSHA 10-hour and 30-hour courses go over these regulations, but the classes themselves aren’t federally mandated. 

Still, employers need to make sure employees go through training in a language they can understand. Sometimes, a qualified person must lead the course. Frequency depends on the standard, but retraining is often required after site changes, new equipment, or incidents.

Recordkeeping and documentation

Without documentation, OSHA won’t be able to check whether a contractor is compliant. Companies should always document employee training, actions taken to resolve hazards, and inspection results. They should also use OSHA’s 300, 300A, and 301 forms to keep a record of injuries and illnesses. 

Reporting

If the worst does happen, OSHA requires companies to notify the agency urgently. Contractors must report inpatient hospitalizations, amputations, or loss of an eye within 24 hours, and any fatalities within eight hours.

7 steps to getting started with OSHA compliance in construction

Becoming OSHA compliant isn’t something that matters for a single construction project; it’s an ongoing process that applies across every job a contractor takes on. These seven steps cover what to put in place at the company level and how to apply it to every individual job.

1. Establish a safety program.

Safety programs are a preventative measure. They’re designed to catch hazards before they hurt people rather than reacting to injuries after it’s too late. OSHA designed specific safety program standards for the construction industry, and the core elements include: 

  • Management leadership
  • Worker participation
  • Hazard identification and assessment
  • Hazard prevention and control 
  • Education and training
  • Program evaluation and improvement
  • Communication and coordination for employers on multiemployer worksites

According to OSHA, the processes outlined in this guide aren’t set in stone. Contractors are free to adapt them to their company’s needs. But the ultimate goal, as always, should be creating the safest possible workplace for employees. 

This company-wide system applies to each jobsite. Once it’s in place, contractors need to develop specific plans for every site to address that job’s unique risks. 

2. Create a written safety plan for each site.

Contractors should customize the company safety program for each jobsite to address their individual hazards and standards of work. Plans should include: 

  • Site information like address, GC, project number, scope of work
  • Site map with hazard zones, access routes, and emergency exits
  • The OSHA standards triggered by this scope (e.g., Subpart P for excavation over five feet, Subpart M for fall protection above six feet)
  • Named competent people for each regulated activity (such as fall protection, excavation, and scaffolding)
  • Site-specific PPE requirements by task
  • Hazard inventory and corresponding controls
  • Locations of safety supplies like safety data sheets, first aid kits, and automated external defibrillators
  • Emergency action plan with muster points and evacuation routes
  • Multiemployer coordination like GC site rules, sub coordination procedures, and site-specific rules from the controlling employer
  • Training verification detailing who on this crew has the certifications this scope requires
  • Incident reporting contacts and procedures for this site

3. Designate competent people.

For specific roles, jobsites need a competent person available to make decisions and ensure all equipment and supplies are up to standard. According to OSHA, a competent person is someone trained in hazard detection or experienced enough to identify hazards, inspect equipment, and take reparative action if required. Contractors typically keep a list of qualified people for common tasks, then assign them to jobsites as needed.

Keep in mind that different standards, like fall protection and excavation, require separate competent people with specialized expertise. In many cases, contractors will need multiple trained people on-site at all times.

4. Provide required and voluntary training.

All workers should receive adequate training, both in OSHA general requirements and individual jobsite hazards and standards. OSHA mandates topic-specific training (like fall protection, scaffolding, and hazard communication) any time a worker is exposed to that hazard. Some standards may need to be discussed on a set schedule, often annually. Competent or qualified people may need to teach the lessons, and training must be in a language workers understand. To comply with OSHA regulations, companies need to document who needs training and whether they’ve completed it. 

While it’s a voluntary program, OSHA recommends that construction workers receive OSHA Outreach Training. This course can take either 10 hours (OSHA 10) or 30 hours (OSHA 30) and certifies that the worker understands OSHA standards and expectations.

5. Ensure workers have suitable PPE.

Contractors need to ensure all eligible workers have appropriate PPE for their individual roles and site. Generally, employers provide PPE and are responsible for making sure it’s in good condition. OSHA now explicitly requires employers to provide PPE that fits each worker properly, which closes a long-standing gap for women and smaller-statured workers. They should also offer training so employees know how to use it. In the rare cases that workers provide their own PPE, the employer is still required to verify its suitability. 

Some types of PPE must also meet American National Standards Institute (ANSI) requirements for quality. Here are several examples and the relevant ANSI standards:

6. Post required notices.

Workers should always be able to access information about safety protocols and updates. OSHA offers many downloadable posters and flyers on topics like forklift safety, fall protection, and lockout-tagout procedures that contractors can post or distribute around the workplace to demonstrate compliance. 

7. Keep records.

Employers should use OSHA forms 300, 300A, and 301 to keep records of all incidents. OSHA expects this documentation even if no injuries occurred, so companies must make these forms available and accessible for potential inspections. At the end of the calendar year, employers must review the previous year’s logs, complete the Form 300A summary, and post it in the workplace between February 1st and April 30th.

Benefits of OSHA compliance for construction projects

Following OSHA standards helps companies avoid citations, but it also offers the following benefits to contractors: 

  • Safeguarding well-being: The health and safety of their team should be contractors’ number one priority. OSHA has designed its standards to improve workplace safety, and by following them, contractors can reduce the frequency of accidents and injuries, safeguarding well-being.
  • Lessening the financial impact of injuries and incidents: According to the National Safety Council, workplace injuries cost employers an average of $1,120 per year per worker. Following OSHA’s standards reduces the number of injuries and incidents, reducing this financial burden.
  • Stronger EMR, lower premiums, and more bid opportunities: When contractors apply for insurance, providers look at their Experience Modification Rate (EMR), which measures the cost of previous injuries and the likelihood of them happening again. A lower EMR leads to more affordable workers’ compensation premiums. It also expands bid opportunities, since many GCs and project owners require an EMR below a set threshold (often 1.0) before a contractor can submit a bid.
  • Legal protection and reduced liability: If parties like project owners or injured workers raise legal challenges related to health and safety, being able to prove OSHA compliance can demonstrate to the courts a commitment to safety.
  • A better employee experience: When companies put up OSHA posters, hold safety meetings, and have clear hazard protocols, they tell employees they appreciate their safety and well-being. Workers are also more likely to trust in the safety of a jobsite when there are visible safety programs in place, improving morale and workplace experience. According to Gallup, employee experience directly ties to retention and performance
  • Improved clarity: Clear documentation and standardization tell workers exactly what they need to do each day. Instead of wasting time wondering what to do next, crews can get to work. For example, if a worker is unsure whether a scaffold is safe to work from, pausing to check with their supervisor wastes precious time.

How to build an OSHA-compliant culture

Here are some tips contractors can follow to ensure they build OSHA regulations into their workplace culture: 

  • Always have a visible and available competent person (or people) on-site. 
  • Make it easy for crews to flag hazards and near-misses. Workers see things every day that could lead to an incident if left alone, like a loose guardrail, a frayed cord, or a sub working without proper fall protection. Make sure your team knows how to flag these in the moment, and encourage them to do so. This information prevents accidents before they happen.
  • Hold daily toolbox talks or pre-task safety meetings to communicate current risks and unique conditions. 
  • Track and investigate every incident. When something does happen, capture it in detail: what occurred, who was involved, contributing conditions, and any injuries. Consistent reporting builds the data set that helps you spot patterns across jobs and prove your safety record to GCs and insurance carriers.
  • Inspect jobsites, tools, and equipment daily. Take note of and resolve any discrepancies. 
  • Make OSHA-approved safety information, like fire protocols, necessary PPE, and chemical handling details, available to staff at all times.
